Please read these terms carefully before using The Clue Card.

1. Introduction

These Terms & Conditions govern your use of The Clue Card website and services (together, “the Service”). By creating an account, purchasing a Clue Card, or making a donation, you agree to these terms in full.

If you do not agree, please do not use the Service.

2. About Us

We are not a registered charity. We are a social enterprise with a charitable mission built into our business model. Gift Aid does not apply to any payments made through the Service.

3. Definitions

  • Card — the physical NFC-enabled Clue Card we supply.
  • Profile — the personal information record you create and associate with a Card.
  • Cardholder — the person whose information appears on a Profile.
  • First Responder — anyone (professional or bystander) who taps a Card or enters a card phrase to view a Profile.
  • We / Us / Our[COMPANY LEGAL NAME].
  • You / User — the person who creates an account and uses the Service.

4. Eligibility

You must be at least 18 years old to create an account or make a purchase. By using the Service, you confirm that you are 18 or over.

The Service is currently available to residents of the United Kingdom only.

5. Account Registration

You must create an account to purchase a Card or make a donation. You agree to provide accurate, complete information when registering and to keep your details up to date.

You are responsible for keeping your password secure and for all activity that takes place under your account. If you suspect unauthorised access, contact us immediately at hello@thecluecard.com.

You may only hold one account. Creating multiple accounts to circumvent limits or promotions is not permitted.

6. Profiles & Sensitive Data

Your account can hold multiple Profiles — for example, for yourself, a family member, or (if you are a business or school) for people in your care.

Profiles may include sensitive personal information: health conditions, medications, allergies, emergency contacts, and photographs. You are responsible for ensuring this information is accurate and kept up to date. We do not verify the medical accuracy of anything you enter.

If you are creating a Profile for someone else, you confirm that you have their consent (or the consent of a parent or guardian where the person is a child or lacks capacity) to store and display their information through the Service.

Health and medical data is classified as special category data under UK GDPR. We take its protection seriously. See Section 14 and our Privacy Policy for full details of how we handle it.

7. The Physical Card

The Clue Card is a passive NFC-enabled wallet card. When tapped against a modern smartphone — or when the card phrase and security code are entered on our website — the linked Profile is displayed.

The Card is not a medical device. It is not a substitute for formal clinical medical identification, a MedicAlert bracelet, or official emergency documentation. The information displayed is provided entirely by you and has not been reviewed or verified by us or any medical professional.

The Card does not require a battery, signal, or internet connection from the Cardholder. It works on any modern smartphone.

8. Purchasing a Card

Cards are priced at £10 each, including free standard delivery within the UK.

Payment is taken at the time of order via our payment provider, Stripe. By purchasing, you also agree to Stripe's end-user terms.

Once a Card has been dispatched, it cannot be returned or refunded unless it arrives damaged or defective. This is because physical cards are personalised to your order. Your statutory rights are not affected.

If your Card arrives damaged, please contact us within 14 days of delivery and we will arrange a replacement.

9. One-Off Donations

You can make a one-off donation of any amount. For every £10 we receive in donations, we send one Clue Card to a charity partner of your choice to distribute to someone who needs it.

We are not a registered charity. Donations made through the Service are payments to [COMPANY LEGAL NAME] in support of our charitable mission. Gift Aid does not apply.

Donations are non-refundable once payment has been processed. The charity you select will receive donated Cards, but we retain responsibility for how those Cards are manufactured and dispatched. Charity partners are responsible for distributing Cards to recipients.

10. Recurring Donations

You can set up a recurring donation, billed at the frequency you choose (for example, monthly). Each billing period, your chosen amount is charged automatically via Stripe.

Your right to cancel: You may cancel a recurring donation at any time through your account settings or by emailing hello@thecluecard.com. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel within 14 days of first setting up a recurring donation without giving a reason. After this period, you may still cancel at any time and no further charges will be taken after the current billing period ends.

Cards already donated before cancellation will not be recalled.

11. Delivery

We currently deliver to UK addresses only. We aim to dispatch Cards within [X] working days of your order being confirmed. Delivery is by Royal Mail or a similar carrier.

Risk of loss passes to you on delivery. If your Card is lost in the post or arrives in a damaged condition, please contact us within 14 days and we will do our best to help.

12. Card Activation & Linking

Each Card has a unique phrase and security code printed on it. To activate your Card, you link it to a Profile through your account. Until a Card is linked to a Profile, tapping it or entering the phrase will not display any personal information.

Cards issued to businesses or schools may be re-linked to a new Profile when appropriate (for example, when a card is passed to a new employee or student). At the point of re-linking, all previous Profile data is removed from the Card.

13. Public Profile Access

Once a Card is activated, the linked Profile can be viewed by anyone who taps it with a smartphone or enters the card phrase on our website — no account or login is required. This is intentional: the whole point is that a First Responder can access the information quickly in an emergency.

You control which fields are visible in a Profile. Only the fields you choose to display will be shown. By activating a Card, you accept that the Profile information you have chosen to display will be accessible to anyone who has the physical card or knows the card phrase.

We implement measures to prevent automated bulk lookups (such as rate limiting), but we cannot guarantee that a Profile will never be accessed by someone other than a First Responder.

14. Data Protection & Privacy

We collect and process personal data — including name, email address, health information, photographs, and payment details — in order to provide the Service. Our lawful basis for processing is performance of a contract with you.

Your rights under UK GDPR include the right to access, correct, delete, and export your data. To exercise these rights, contact us at hello@thecluecard.com.

15. Acceptable Use

You agree not to:

  • Enter false, misleading, or inaccurate information in a Profile.
  • Use a Card or Profile that belongs to another person without their explicit consent.
  • Attempt to access another person's Profile by guessing card phrases or security codes.
  • Make fraudulent purchases or donations.
  • Use the Service in any way that could harm others or bring The Clue Card into disrepute.

We reserve the right to suspend or terminate accounts that breach these rules, without notice where necessary.

16. Our Liability

The Clue Card is a personal information tool, not a medical device or emergency service. We do not provide medical advice. First Responders who access a Profile make their own independent decisions about how to use the information shown.

You are responsible for the accuracy of the information in your Profiles. We are not liable for any harm arising from inaccurate, incomplete, or out-of-date Profile information, or from a First Responder acting on that information.

We are not liable for any failure of the Card or Service caused by factors outside our control, including network outages, smartphone compatibility issues, or the Card being lost or damaged.

To the fullest extent permitted by law, our total liability to you for any claim arising from your use of the Service is limited to the amount you paid to us in the 12 months before the claim arose.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other matter that cannot be excluded by law. Your statutory consumer rights are not affected.

17. Intellectual Property

All content on our website — including text, design, logos, and code — is owned by or licensed to [COMPANY LEGAL NAME] and is protected by copyright and other intellectual property laws.

You retain ownership of any photographs or content you upload to a Profile. By uploading content, you grant us a non-exclusive, royalty-free licence to store and display it to authorised viewers (i.e. anyone who accesses your Profile via a Card). You confirm that you own or have the right to use any content you upload.

18. Third-Party Services

We use Stripe to process all payments. Your payment details are handled directly by Stripe and are subject to Stripe's privacy policy and terms. We do not store your full card details.

Charity partners who receive donated Cards are independent organisations. They are responsible for how they distribute Cards to recipients. They are not our agents and we are not responsible for their actions.

19. Closing Your Account

You can close your account at any time by contacting us at hello@thecluecard.com. We will delete your personal data in accordance with our Privacy Policy and your rights under UK GDPR. Any active recurring donation will be cancelled at the same time.

When your account is closed, all Profiles linked to your account will be deleted. Any Cards previously linked to those Profiles will become inert — tapping them or entering the card phrase will no longer display any information.

We may suspend or close your account without notice if we believe you have breached these terms.

20. Changes to These Terms

We may update these terms from time to time. When we do, we will notify you by email or through a notice on the website at least 14 days before the changes take effect. Your continued use of the Service after that point means you accept the updated terms.

The current version of these terms is always available on this page, with the date it was last updated shown at the top.

21. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
